Incredible…<\/p>\r\n PART 2 \u2013VACCINE REQUIREMENTS IN RELATION TO COVID<\/strong><\/p>\r\n …<\/strong><\/p>\r\n [102] <\/strong>There can be absolutely no \u00a0doubt that vaccines are a highly effective tool for protection against a \u00a0variety of diseases. The focus of this decision, however, is not the \u00a0pros and cons of vaccination. It is about the extent to which mandatory \u00a0COVID vaccinations can be justified, as to do so impinges on other laws, \u00a0liberties and rights that exist in Australia.<\/p>\r\n [103] <\/strong>It has been widely accepted that for the overwhelming majority of Australians, vaccination should be voluntary.<\/p>\r\n [104] <\/strong>The commonly accepted \u00a0definition of voluntary includes acting of one\u2019s own free will, optional \u00a0or non-compulsory. This is the opposite of the definition of mandatory, \u00a0which is something that is compulsory, obligatory or required. \u00a0Something that is mandatory must be done.<\/p>\r\n [105] <\/strong>The stated position of the \u00a0Australian Government is that the vaccine is voluntary. On 21 July 2021, \u00a0the Prime Minister in a media conference stated that \u201cpeople make their \u00a0own decisions about their own health and their own bodies. That\u2019s why \u00a0we don\u2019t have mandatory vaccination in relation to the general \u00a0population\u201d.<\/p>\r\n [106] <\/strong>On 13 August 2021, the \u00a0Australian Council of Trade Unions (ACTU) and the Business Council of \u00a0Australia (BCA) issued a joint statement on mandatory COVID vaccinations \u00a0in which it acknowledged the Australian Government\u2019s COVID vaccination \u00a0policy that the vaccine is voluntary, and confirmed the views of the BCA \u00a0and ACTU that \u201cfor the overwhelming majority of Australians, your work or workplace should not fundamentally alter the voluntary nature of vaccination<\/u>\u201d. (emphasis added)<\/p>\r\n [107] <\/strong>The Fair Work Ombudsman has \u00a0publicly stated that employers will need to have a \u201ccompelling reason\u201d \u00a0before requiring vaccinations, and that \u201cthe overwhelming majority of \u00a0employers should assume that they can\u2019t require their employees to be vaccinated<\/u> against coronavirus\u201d. (emphasis added)<\/p>\r\n [108] <\/strong>Safe Work Australia has publicly stated that \u201cmost employers will not need to make vaccinations mandatory<\/u> to meet their [health and safety] obligations\u201d. (emphasis added)<\/p>\r\n [109] <\/strong>Despite this, many \u00a0employers are declaring they will mandate COVID vaccines for their \u00a0workers, and PHOs are being made by State Governments, in circumstances \u00a0where there is no justification for doing so.<\/p>\r\n Mandatory vaccination cannot be justified<\/em><\/p>\r\n [110] <\/strong>COVID vaccinations, in \u00a0accordance with the Australian Government\u2019s policy, must be freely \u00a0available and voluntary for all Australians.<\/p>\r\n [111] <\/strong>Mandatory COVID \u00a0vaccinations, however, cannot be justified in almost every workplace in \u00a0Australia. While there are numerous reasons for this, this decision will \u00a0focus on:<\/p>\r\n a) the requirement for freely given and informed consent for medical procedures;<\/p>\r\n b) \u00a0denying an unvaccinated person the ability work on health and safety \u00a0grounds, whether at the initiation of an employer or as part of a PHO; \u00a0and<\/p>\r\n c) the requirements to comply with disability discrimination laws.<\/p>\r\n [112] <\/strong>There is of course a degree \u00a0of overlap with the reasoning applicable to the inability to justify \u00a0mandatory vaccination whether at the initiative of employers or as part \u00a0of a PHO, however I have not repeated the reasons under each separate \u00a0heading.<\/p>\r\n [113] <\/strong>Before turning to a \u00a0consideration of these reasons, it is important to set the context with \u00a0some information that is publicly available and should be \u00a0uncontroversial:<\/p>\r\n a. \u00a0Unlike many other vaccinations such as those used to stop the spread of \u00a0tetanus, yellow fever and smallpox, COVID vaccinations are not designed \u00a0to stop COVID. They are designed to reduce the symptoms of the virus, \u00a0however a fully vaccinated person can contract and transmit COVID.<\/strong><\/em><\/u><\/p>\r\n b. \u00a0The science is clear in that COVID is less serious for those who are \u00a0young and otherwise healthy compared to those who are elderly and\/or who \u00a0have co-morbidities. In other words, the risk of COVID is far greater \u00a0for those who are elderly or have co-morbidities. Around 87% of those \u00a0who have died with COVID in Australia are over 80 years old and had \u00a0other pre-existing illnesses listed on their death certificates.<\/strong><\/em><\/u><\/p>\r\n c. \u00a0The World Health Organisation has stated that most people diagnosed \u00a0with COVID will recover without the need for any medical treatment.<\/strong><\/em><\/u><\/p>\r\n d. The vaccines are only provisionally approved for use in Australia and are accordingly still part of a clinical trial\u00a0<\/strong><\/em><\/u>20<\/strong><\/em><\/u><\/a>.<\/strong><\/em><\/u><\/p>\r\n e. There are side effects to the COVID vaccines that are now known. That side effects exist is not a conspiracy theory.<\/strong><\/em><\/u><\/p>\r\n f. \u00a0The long-term effects of the COVID vaccines are unknown, and this is \u00a0recognised by the Therapeutic Goods Administration (TGA) in Australia.<\/strong><\/em><\/u><\/p>\r\n Consent is required for participation in clinical trials<\/em><\/p>\r\n [114] <\/strong>Consent is required for all \u00a0participation in a clinical trial. Consent is necessary because people \u00a0have a fundamental right to bodily integrity, that being autonomy and \u00a0self-determination over their own body without unconsented physical \u00a0intrusion. Voluntary consent for any medical treatment has been a \u00a0fundamental part of the laws of Australia and internationally for \u00a0decades. \u00a0 [115] <\/strong>Coercion is not consent. \u00a0Coercion is the practice of persuading someone to do something using \u00a0force or threats.
